Refund Policy
1. Introduction
The Australian Consumer Law sets out consumer rights. These include your rights to a repair, replacement or refund where a product or service you buy fails to meet our consumer guarantee.
2. Purpose and scope
This policy applies to the refund of tutoring fees that have been paid by students.
3. Background
Brain Beans collects fee using following methods:
- Pay as you go – payment for each session planned is requested via invoice a week or 7 days prior to the usual scheduled session.
- Pre-pay – a package of set number of classes can be purchased for a discount.
Brain Beans offers:
- One-to-one tutoring programs (‘Individual Learning’) and.
- Small group tutoring programs (between two and five students) (‘Group Learning’).
If you are enrolled with us on Individual Learning
- If you cancel a scheduled tutoring session:
- More than 3 days before the scheduled session, you can schedule a makeup lesson at a different time or request a full credit by giving us a call.
- 48 hours before the scheduled session, you can schedule a makeup lesson at a different time or request a partial credit (50% of session’s cost)) by giving us a call.
- The same day as that session is scheduled, at least three (4) hours prior to your session, you can reschedule your session for another time to avoid losing the fee, and no credits apply.
- Less than 1 hour before the scheduled session or fail to appear for a session, you will not be entitled to reschedule that session, nor are you entitled to a credit.
- We refund any credits in your account which can be used for future classes or credited to your nominated bank account. Please allow us 7 days to finalize the statements and organize a refund.
- The fees related to discounted sessions are also refundable as per above. Credits are applied at a discount rate per session.
If you are enrolled in Group Learning:
- More than 5 days before the scheduled session, you can request a full credit or request for makeup lesson with a different group (subject to availability and scheduled group times).
- More than 3 days before the scheduled session, you can request a partial credit (50% of session’s cost) or request for a makeup lesson with a different group (subject to availability and scheduled group times).
- If you miss a session or can’t make an upcoming session, no credit is available if less than 1 days’ notice is provided. You can still access recordings for any missed sessions.
- We refund any credits in your account which can be used for future classes or credited to your nominated bank account. Please allow us 7 days to finalize the statements and organize a refund.
- The fees related to discounted sessions are also refundable as per above. Credits are applied at a discount rate per session.
4.1 Cancellation where there is a failure in delivery of a session.
Brain beans sessions come with the guarantee that they will be:
- provided with acceptable care and skill or technical knowledge.
- fit for the purpose.
- delivered within a reasonable time frame of the scheduled session times/s.
Brain Beans will provide a full refund if requested, where the service:
- has a problem that would have stopped you from buying it if they had known about it; or
- is substantially unfit for its purposes and cannot easily be fixed with a reasonable time; or
- does not meet the specific purpose that it was intended.
If the failure occurs for reasons other than above, Brain Beans will provide a makeup session free of charge.
